Understanding of CAA and NRC , clarifying certain myths

Citizenship is a matter of importance for every country. A citizen is a legally recognized national residing in the territory of a country under the ambit of the lawful provisions thereof. It makes easy for the person to defend his/her rights against the State. With grant of citizenship comes the influx of all the rights guaranteed under the Constitutional and legal framework of that country. It helps a person defend himself/herself against any type of authoritarianism.  It becomes important for a nation to recognize its citizen as a nation without citizen ceases to be a nation.

The recent amendment to The Citizenship Act has sparked some controversies. It is a mere extended amendment to the Citizenship Act, 1955. Most of them being because of the gross misinformation being spread by those political parties that wish to keep their vote bank politics intact. The violence that erupted seems to be the consequence of this misinformation campaign. The most laughable part of the whole campaign seems that no one knows what exactly the Citizenship Amendment Act is all about. Everyone seems to be falling prey to the propaganda instead of  actually separating fact from farce. Everyone is too busy speaking against the law which explains why they don’t have time to actually read the law. 

The Citizenship Amendment Act does not affect any Indian Citizen. In fact, the new amendments have nothing to do with the Indian citizen. It speaks of the persecuted minorities. The words of the Act are clear and concise. It only speaks of people who are “religiously persecuted” from the countries that have declared their state religion i.e. Pakistan, Afghanistan and Bangladesh. It also specifies the which religious minorities are to be granted citizenship namely, Hindus, Jains, Buddhists, Sikhs, Parsis and Christians. People who belong to these religions if they wish to enter India or have already entered India on or before 31.12.2014, shall not be treated as illegal immigrants. Instead, they would be granted citizenship provided they apply for the same, on the grounds that they have been “religiously persecuted” from their countries mentioned specifically in the Act. Further it also clarifies that people who belong to any of the above mentioned six religions should have to be living in India for past five years, only then will they be eligible to grant of citizenship.

There  have been a lot of misinformation has been  circulated through by using gullible minorities and civil society activists who are ready to raise there flag at drop of hat .Some of the most common arguments against NRC CAA . Moreover they keep on changing depending upon the intellect of audience

muslims residing in india will be dumped in Arabian sea . Totally false as all residents of india with any proof dont need to worry 

All muslims will be kept in detention camp (what are they smoking)  this is mainly to stop mass illegal emigration of muslims from three neighbouring islamic state  bordering state viz Pakistan , Bangladesh and afghan who have close ethnic ties with india 

Why just allow minorities from these countries and not other sub sects like rohingyas , hazras and ahmediyas . - Bangladesh dont want them as they are being treated as person non grata because of their general criminal tendency, links with ISIS  and they are asking for a separate state in burma . Thats why the Nobel laureate ang song suchi is also not tolerating them . As far as ahmediyas and hazras are concerned we are not intrested to solve whole world problem. Those who are crying hoarse can marry them which will automatically gave them right to residency. 

Why are muslims not allowed This is because these minorities i.e hindus jains , sikhs . Christian, parsis ,bodh are facing grave atrocities because of the belief they follow . Already the number of them in these countries have been dwindling very fast because of state supported conversion and other atrocities. Even nehru has signed a pact in 50 for providing support to each other to their residents support to change their citizenships . Also same was the case in uganda crisis and 71 bangldesh when 5 Cr bangla entered india and indira legitimise all of them 

To prove your identity . None of govt issued documents will be legal ( totally wrong)

It will hurt the social fabric of the country (its responsibility of all citizens ) - india doesn’t need to prove its secular credentials who have given all top posts to muslims like president , Vice President,ministers cabinet secretary etc . All film artists have never faced any hostility rather they are the darling of the crowd . 

Muslims have to time and again prove their alliances . Its the illiterate one who get used by certain political brokers to their advantage and forget there brain . I dont know where . Cricket which is a religion in india has never discriminated any player on basis of religion by public or doubted them for their. belief in any walk of life .

Indian enjoy ghulam ali with equal aplomb as they do their jagjit .Whether bismillah khan , amjad ali khan , zakir khan , allah rakhaa , MF Hussain , moosa raza all were treated with star status without any discrimination because of their belief . So how can any one doubt the commitment. India is the only country in the world which gives subsidies for haj travel . So govt trying to propagate that they are short changed . No religious bias by any one . 

No muslim who are national awardees and had returned them on account of muslim persecution have been  troubled by state and they still voice their opinion on all forums . 

One argument used is the required documents, its still not a law and nitty grities will be decided soon . This is a total wrong information being propagated that for muslims they will have to get birth certificate of their father and grandfather which they might not be having . This is total false propaganda being promoted by vested interests 

There is a lot of hue and cry about being unconstitutional, which is totally wrong as described in sections of article 14 also certain countries like pakistan afaghanistan and bangladesh people who have ethnic ties with india can be granted immigration under certain conditions and this ia policy decision which can be done by parliament and is in mo way against spirit of constitution . Even legal eagle have given their opinion and if they feel it is legally unconstitutional than use courts rather taking law under their hand . 

I am not able to understand that why the people opposing CAB NRC throw constitution in dust bin 

Combining NRC and CAB which is again trying to mislead the poor illiterate gullible minorities. Which they just donot understand and thereby confusing them even more and thereby using them as weapons 

Another false claim being used  that baba saheb ambedkar had written in preamble declaring india as secular socialist state . Which is not , it was added in 70’s 

Here is another fact 

*Indira Gandhi was elected to the 5th Loksabha in March 1971. Her term ended in march 1976.*

_Elections in the normal course should have been held, latest by March 1976.

National Emergency imposed 26th June 1975 though there was no emergency situation in india.

42nd amendment to Constitution was introduced in Loksabha on 1st SEPTEMBER 1976 by H.R.Gokhale, the then union Law minister,. ...i.e _AFTER THE TERM OF of the 5th Loksabha

 LOKSABHA TERM OF 5 YEARS HAD ENDED IN MARCH 1976 ITSELF. BUT THE SAME LOKSABHA CONTINUED IN 6TH AND 7 TH YEAR ALSO.

42nd amendment was passed when almost all of opposition was jailed (during emergency) and parliament was attended only by Indira Gandhi's men!

Provisions of 42nd amendment was applicable *after* the regular term of the 5th Loksabha! 

42nd amendment added the words "SECULAR" and "Socialist" to the Constitution!

The current political dispensation of CAB AND NRC is enacted when it follows the the correct procedure to enact laws. No opposition leader is jailed. Debate is allowed within & outside the Parliament

Media and others are free to comment and criticise the acts of the government.

Yet, all those who are the drum beaters of secularism don't have the intellectual honesty to opine that *the addition of the words "Secular" and "Socialist" to the preamble of our Constitution in 1976 September was through a defacto ILLEGAL parliament!* 

And these same defenders of secularism accuse the current government of being fascists! Height of ignorance 

If the Modi government emulates Indira Gandhi and removes the words "Secular" and "Socialist", after jailing the complete opposition, will all those who are defending secularism, defend Modi's action?  NO, not at all 

After all,  those words were added when there was virtual dictatorship 

Majority of Indians were not even born when this episode happened so their opinion is based on a lot of misinformation 

There is catch 22 situation for the people’s who initially committed agaisr NRC & CAA ,on one hand the people opposing CAB NRC are opposing it on basis of secular fabric and on other hand that means throwing constitution by throwing democratic rules in dustbin

Modi’s potent combination of Hindu majoritarianism ,squeaky clean image , well oiled propaganda machinery and authoritarianism will not be defeated easily .the passage of the citizenship act has consolidated the their leadership whithin party and pushing opposition in corner . the opposition which is trying to use civil society to create movement against ruling disposition because they also cant be aeen openly siding towards minorities, which they used to earlier on . There is a majority vocally supporting the BJP and particularly NAMO SHAH combo . 

This is because of their no nonsense approach . And taking tough decisions without blinking an eyelid . I have been harping since long they have only them-self as competition, no outsiders is even close . 

The two work so hard in running the government and politics. I haven’t seen anyone even close to their commitment.they understand the fabric of india very intricately and have an iron grip over legislation and executive. Moreover they are playing like a game of chess , keeping in mind most of the combinations and permutations. They have also divided there job very beautifully. You hate it or love it but they are here to stay . NRC CAB 370 ayodhya  will consolidate their political positions more in national politics.
